The FAA requires a drone pilot to have a certificate if the pilot receives any form of compensation for the drone flight. Compensation includes money and non-monetary rewards such as benefits, discounts, freebies, or in-kind services. If a drone pilot receives anything of value, directly or indirectly, for providing drone flying services, this is considered compensation. Being compensated for commercial drone flying requires the pilot to have an FAA certificate.
The civil penalties for flying a drone Commercially without first obtaining an FAA Pilot's Certificate are up to $32,000.00 for each incidence.
This fine is charged per day for continual illegal use of a drone for commercial purposes.
The FAA may also impose ciminal sanctions, which include a fine of up to $250,000.00 and/or a prison sentence of up to three years upon conviction.
A person who knowingly hires an un-licensed drone pilot for a commercial operation can be fined as much as 10x more than the pilot. An unlicensed drone pilot who flies commercially for any sort of compensation will be fined 1,100.00 per occurrence by the FAA.
If a Realtor purchases a drone, and uses the drone to photograph his/her own listings, they can be fined twice, adding up to $12,100.00 in fines, per occurance.
